Abstract
PL W niniejszym artykule autorka przedstawiła prawne aspekty funkcjonowania odpowiednika Naczelnego Dowódcy Sił Zbrojnych we Francji poprzez charakterystykę zadań organów cywilnych i wojskowych. Artykuł podzielony został na dwie części i ten fragment stanowi dopełnienie części pierwszej, w której wskazano rozwiązania zastosowane w Republice Francuskiej w zakresie roli i miejsca odpowiednika Naczelnego Dowódcy Sił Zbrojnych w systemie kierowania bezpieczeństwem narodowym oraz metodologiczne wprowadzenie. Obecny stan prawny w Republice Francuskiej pozwala stwierdzić, że organy władzy wykonawczej – wykonujące zadania przyporządkowane do stanowiska Naczelnego Dowódcy mają ugruntowaną pozycję, tak w systemie konstytucyjnym, jak i w systemie kierowania bezpieczeństwem narodowym. Wynika to zarówno z uwarunkowań historycznych, tradycji ich funkcjonowania oraz - co istotne, z przyjętego zwyczaju wykonywania zadań. Prezydent Francji wskazywany jest jako Naczelny Dowódca.
EN In this article, the author presented the legal aspects of the functioning of the equivalent of the Commander-in-Chief of the Armed Forces in France by characterizing the tasks of civil and military authorities. The article is divided into two parts and this fragment complements the first part, which indicates the solutions used in the French Republic regarding the role and place of the equivalent of the Commander-in-Chief in the national security management system and a methodological introduction. In accordance with legal regulations, the executive authorities performing the tasks of the Commander-in-Chief’s equivalent have an established position in both the constitutional system and the national security management system. This division results both from historical conditions, the tradition of their functioning and - importantly, from the adopted custom of performing tasks. The President of France is designated as Commander-in-Chief.
