PL Celem niniejszego artykułu jest analiza zasad prawnych oraz rozwiązań organizacyjnych, które regulują i umożliwiają aktywność klas mundurowych w systemie bezpieczeństwa państwa. Na potrzeby przeprowadzenia badań sformułowano problem badawczy: Jakie są podstawy prawno-organizacyjne funkcjonowania klas mundurowych? Przeprowadzone badania dowodzą, że proces prawno-organizacyjnych podstaw funkcjonowania klas mundurowych, podlega stałej ewaluacji, a ze względu na poszukiwanie efektywnych możliwości wykorzystania tych klas w systemie bezpieczeństwa państwa, najprawdopodobniej nadal będzie modyfikowany. Kolejny wniosek, jaki nasuwa się z przeprowadzonej analizy, to niezbędna instytucjonalizacja, nie tylko klas wojskowych, ale i innych klas mundurowych, w tym m.in.: policyjnych, pożarniczych, Straży Granicznej, Służby Więziennej, Służby Celnej. Ponadto konieczna wydaje się współpraca różnych resortów w celu tworzenia jednolitych prawno-organizacyjnych rozwiązań, we wszystkich różnych klasach mundurowych. Do rozwiązania postawionego problemu badawczego i weryfikacji hipotezy badawczej, zastosowano teoretyczne metody badań, takie jak analiza, synteza, wnioskowanie, abstrahowanie oraz metodę analizy i krytyki piśmiennictwa.
EN The aim of this article is to analyse the legal principles and organizational solutions that regulate and enable the activities of uniformed classes within the state security system. For the purposes of the study, the following research question was formulated: What are the legal and organizational bases for the functioning of uniformed classes? The conducted research proves that the process of shaping the legal and organizational foundations for the functioning of uniformed classes is subject to constant evaluation and – due to the search for effective ways to utilise these classes within the state security system – will most likely continue to be modified. Another conclusion that arises from the conducted analysis is the necessary institutionalization, not only of military classes, but also of other uniformed classes, including: police, fire brigade, Border Guard, Prison Service, Customs Service. In addition, cooperation between various ministries seems necessary in order to create uniform legal and organizational solutions in all different uniformed classes. To address the research problem and verify the research hypothesis, theoretical research methods were employed, including analysis, synthesis, inference, abstraction, as well as the method of literature analysis and critique.
