PL W tekście zostanie przedstawiona recepcja zasady samostanowienia narodów w polskiej myśli polityczno­‑prawnej w I połowie XX wieku. Podstawową cezurę czasową będą stanowiły lata 1914–1945, kiedy to po przeszło wiekowej niewoli zaczęły się pojawiać pierwsze polskie publikacje podejmujące zagadnienie bytu państwa i jego suwerenności jako podmiotu prawa międzynarodowego. Punktem wyjścia dla rozważań podjętych w tekście będzie doktryna polskiej szkoły prawa narodów, wypracowana w XIV wieku przez Pawła Włodkowica i Stanisława ze Skarbimierza, a następnie rozwijana między innymi przez Jakuba z Szadka. Następnie zostaną przywołane prace powstałe na przełomie XIX i w początkach XX wieku, między innymi Emmericha de Vattela i Pasquale Manciniego, do których odwoływali się tak prawnicy, jak i politycy w okresie międzywojennym. Właściwa część tekstu zostanie podzielona na dwie części: doktrynalną i praktyczną. Pierwsza będzie poświęcona recepcji zasady prawa samostanowienia narodów na gruncie polskim, a druga – rozważaniom nad możliwością jej praktycznego zastosowania, które zauważamy szczególnie pod koniec lat 30. XX w kraju i w pierwszej połowie lat 40. na emigracji. W powyższym kontekście przeprowadzona zostanie analiza prac między innymi prawników związanych z Uniwersytetem Stefana Batorego w Wilnie, to jest Wacława Komarnickiego i jego uczniów: Michała Króla, Stanisława Kódzia i Wiktora Sukiennickiego. Przywołane zostaną również opracowania Stanisława Estreichera, Juliana Makowskiego czy Stanisława Leona Huberta.

EN The text presents the reception of the principle of self­‑determination of nations in Polish politico­‑legal thought in the first half of the 20th century. The author focuses on the years 1914–1945, when, after more than a century of captivity, the first Polish publications addressing the issue of the existence of the state and its sovereignty as a subject of international law began to appear. The starting point for the considerations undertaken in the text is the doctrine of the Polish school of the law of nations developed in the 14th century formed by Paweł Włodkowic, Stanisław of Skarbimierz and then elaborated, among others, by Jakub of Szadek. Next, some works written at the turn of the 19th and early 20th centuries, including those by Emerich de Vattel and Pasquale Mancini, are analyzed, to which both lawyers and politicians in the interwar period referred. In the main part of the text, the subject matter is examined in two aspects: doctrinal and practical. The former describes the reception of the principle of the right of selfdetermination of nations in Poland and the latter dwells on the reflections on the possibility of its practical application, which can be noticed especially in the late 1930s in Poland and in the first half of the 1940s in exile. In the above context, an analysis of the works of lawyers associated with the Stefan Batory University in Vilnius, i.e. Wacław Komarnicki and his students: Michał Król, Stanisław Kódź and Wiktor Sukiennicki, is carried out. Studies by Stanisław Estreicher, Julian Makowski and Stanisław Leon Hubert are also mentioned.
