EN Under current law, there is no longer a „minor rectifi cation” when a record contains an obvious clerical error, or a „major rectifi cation” by a court when a civil status record has been incorrectly or imprecisely drafted. Th e provisions of the Civil Registry Offi ce clearly defi ne the conditions that must be met for a record to be rectifi ed by the head of the Civil Registry Offi ce (Civic Offi ce) through a substantive and technical procedure, or by a court. Th e latter will rectify the matter if administrative rectifi cation is not possible. Currently, a request to change the gender designation on a birth certifi cate is subject to court review in non-contentious proceedings, applying the provisions on rectifi cation following the Supreme Court’s resolution (7) of June 22, 1989, which provided for the fi ling of a lawsuit, which became obsolete. Th is change should be considered unfortunate.
