Abstract
EN Th e purpose of this article is to outline the draft of the Council Regulation on jurisdiction, applicable law, recognition of decisions and acceptance of offi cial documents concerning the origin of the child and on the establishment of the European Certifi cate of Parenthood (COM(2022) 695 fi nal), which applies to civil matters concerning the origin of a child in crossborder situations. Th e draft regulation on the origin of children requires Member States to recognise the origin of a child for all purposes when that origin has been established in another Member State. In the author’s opinion, its impact on the situation in countries whose national law does not provide for two-parent same-sex parenthood, including Poland, would be more far-reaching than the CJEU case law to date.
